Do you KeyCite? 

KeyCite is a fully integrated citator and research tool in one easy-to-use service. It is also your best choice for determining whether a case, statute, administrative decision or regulation is good law. Red and yellow status flags, assigned by West’s legal editors after they analyse each case, tell you instantly if a case you are viewing has negative history.

Only KeyCite on Westlaw offers:

  • Depth of Treatment stars – tells you at a glance the amount of discussion on a cited case or administrative decision
  • Pending Legislation – warns you of legislation that may affect a federal or state statute of interest to you
  • KeyCite Alert – automatically tracks cases, statutes, regulations, and administrative decisions and notifies you of any changes
  • West Key Number System® and West full text headnotes – so you know your research is accurate and thorough
  • 2.3 times more citing references than any other citator

With new Graphical KeyCite on Westlaw, it’s easier than ever to get a quick summary on the direct history of the case. Graphical KeyCite allows you to see a “picture” of the direct history of a case, so you can quickly determine how a case has moved through the court system. You can access the graphical view with just a click on the Graphical KeyCite icon when you’re researching a case’s history in KeyCite.

And Finally….

Direct history is added to KeyCite within one to four hours of receipt of a case by West. Severe negative indirect history such as overrulings are identified by attorney-editors within 24 hours of receipt of a case; other negative indirect references are added within a few days. Citing references are available in KeyCite when a case or statute is added to Westlaw.

… so if you don’t KeyCite, you certainly should!

Litigation History Reports

Litigation History Reports can provide a detailed introduction to your judge and opposing counsel in a matter of seconds.

 

Litigation History Reports are current statistical charts available from the Links tab of a judge or attorney profile in the PROFILER-WLD or PROFILER-ALL databases. They are based on federal dockets and all federal and state case law on Westlaw, beginning with 1990, and local dockets from 24 states, beginning with 2000. The reports include lists of cases and links to the court opinions, dockets, and court documents, such as motions and briefs.

The Importance of Unreported

Unreported opinions can be retrieved on Westlaw quickly and easily.

As of January 1, 2007, unless Congress intervenes by December 1, 2006, unreported opinions may also be cited in federal courts, starting next year. See Federal Rule of Appellate Procedure 32.1.

You can retrieve unreported cases on Westlaw using:

  • Terms and Connectors or Natural Language

When you run a Terms and Connectors or Natural Language search in most case law databases on Westlaw, you retrieve reported and unreported opinions in your result. If you want unreported federal opinions only, search one of the databases restricted to unreported federal opinions, e.g. US Courts of Appeals Cases, Unreported (CTAU). For a complete list, type unreported cases in the Search these databases text box and click Go.

  • KeySearch

You can also retrieve unreported opinions using KeySearch, which you can access by clicking KeySearch at the top of any westlaw.com page. With KeySearch, you select topics and subtopics best describing your issue, and KeySearch supplies an expert-level query based on the topic or subtopic you select.

  • KeyCite citing references 

The KeyCite citing references display for a case, statute, regulation, or other document may contain links to unreported opinions as well as to reported ones. Citations to unreported opinions typically include a Westlaw citation (eg, 1992 WL 335796) or the phrase "Table, text in WESTLAW."

Changes to the Print, Email and Download Functionality
Original functionality now reinstated

With reference to the Westlaw UK What's New communication sent out last Tuesday 14th November we have reversed the changes recently implemented to the Print, Email and Download Functionality, and the original functionality is now available.

This decision was made following customer feedback regarding the loss of the ability to deliver multiple documents from the default split screen results list.
