Patry on Copyrights now available on Westlaw

By any measure, the seven-volume, 5,500-page Patry on Copyright is a massive work. The treatise has also been described as:

 

'unarguably the most complete analysis of copyright law, past and present, that has ever been published' 

 

Patry discusses all areas of copyright law and provides invaluable legislative history on the key statutes. He also offers valuable circuit-by-circuit analysis in several areas, including remedies and the design of useful articles. Patry's extensive treatment of remedial, jurisdictional, choice of law and international issues is unparalleled in other publications.

Addition of Space Connector Option


Currently the use of a space in Westlaw results in an 'OR' connector. To avoid any confusion we 
have added an option in Preferences to give you the ability to select whether the space in the query should be interpreted as a '+2' connector or an 'OR' connector.

Internal Revenue Code Number

 

When the IRC section number is all you know, the RIA-IRC database is where to start. Here are some reasons why:

 

When you use the RIA-IRC search template, you do not need to fine-tune a query. Access the database by typing ria-irc in the Search these databases text box. Click the Template tab, type the section number in the IRC Section text box, and click Search Westlaw.

 

Also, it is not necessary to search for materials to help you interpret and apply the section. The below listed links are automatically displayed at the bottom of the Links tab:

• Treasury regulations
United States Tax Reporter (USTR) explanations
• USTR annotations

• USTR committee reports
Federal Tax Coordinator summaries

For example, if you are viewing IRC section 1245, you can click USTR Explanations to retrieve links to six explanations relating to depreciation recapture.

 

Furthermore the USTR explanations are easy to read. You can quickly skim the list of explanations for topics most relevant to your issue. In addition, lists of related explanations and the like are typically of a manageable size; eg section 501 has links to only 35 related regulations and 48 explanations as opposed to 4,800.

Discovery Practice (DISCPR)

Offers trial-tested guidance through all the intricacies of what to do, whether to do it, and how to do it - at every stage of the discovery process.

 

Guide to the International Sale of Goods Convention (INTSLGDS)

A comprehensive guide on the important contractual issues raised by the US adoption of the UN Convention on Contracts for the International Sale of Goods. It covers the terms of the Convention, when it applies, what contracts are covered, and whether usages and practices make a difference.

Recent Cases of Interest

 

Proctor & Gamble – global Satanists?             2007 WL 858689

Procter & Gamble has been awarded $19.25 million in a civil suit filed against four former Amway distributors accused of rumours linking P&G to Satanism.

This was one of several suits the company brought over allegations that the company's logo was a symbol of Satanism. The company's claim was based on the Lanham Act, which prohibits unfair competition and false advertising.

 

Viacom v. YouTube, Google                            2007 WL 775611

Google has been sued for 'massive copyright infringement', accused of putting books in the public domain for commercial use without permission. The lawsuit seeks to block Google from copying the books so that authors would not suffer irreparable harm by being unable to control reproduction of their works.

We are pleased to announce that the Business Law Reports (BULR-RPTS), published by the Incorporated Council of Law Reporting, are now available in full text on Westlaw UK. Coverage begins January 2007.

Designed to meet the needs of chancery and commercial lawyers and those working within the business community, the reports will focus on key areas including:

• Company and commercial law

• Insolvency 

• Intellectual property 

These law reports add a further 2,300 cases to Westlaw UK's current archive of over 200,000 cases and transcripts in full text.

A new checkbox for All Law Reports has been added to the Multiple Database Search screen on Westlaw UK Crime Practice Area Solution. The checkbox will search the CR-RPTS-ALL database.

UK News Quick Search Template

The Independent on Sunday cannot be searched with the other databases in the Quick Search list. As a result of this we have added a note to the bottom of the template explaining saying: This database can only be searched singularly and not in combination with other databases on this list.
